1. Agreement to Terms

These Terms of Service ("Terms") govern your use of the TidyCord Discord bot ("Service"). By adding TidyCord to your Discord server or using any of its features, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

You may use TidyCord only if you:

• Are at least 13 years old (or the minimum age of digital consent in your jurisdiction)
• Comply with Discord's Terms of Service and Community Guidelines
• Are not prohibited from using the Service under applicable law
• Have administrative authority over the Discord server you add TidyCord to
• Have not been previously banned from using TidyCord

3. Description of Services

3.1 Core Features (Free)

• Channel Management: Private channel creation via /claim command
• Voice Channel Automation: Automatic voice channel creation and deletion on join/leave
• Reaction Roles: Role assignment via emoji reactions
• Server Configuration: Admin tools for categories, permissions, and bot setup
• AI Chat Assistant: /chat command with 12 messages/day free limit
• Server Refinement: 5 AI-assisted structure analyses per month

Premium subscribers receive unlimited access to all AI features, extended chat history (150 messages), and all free-tier limits removed.

4. AI Features and OpenAI Integration

By using AI features, you acknowledge that:

• Message content is sent to OpenAI and processed under their Terms of Service
• You comply with OpenAI's Terms of Use
• AI-generated content may be inaccurate, incomplete, or unexpected
• You are responsible for reviewing AI-generated content before use
• We are not liable for the accuracy or appropriateness of AI-generated content

5. Premium Subscriptions and Billing

Premium subscriptions are purchased exclusively through Discord App Subscriptions at $3.99 USD per month (or local currency equivalent as determined by Discord).

• Payment processing: Handled entirely by Discord Inc. We receive no payment data.
• Billing disputes: Must be directed to Discord support
• Cancellation: Cancel anytime through Discord's subscription settings; takes effect at end of billing period
• Auto-renewal: Subscriptions renew automatically unless cancelled
• Price changes: We will notify subscribers 30 days in advance of any price changes

6. Acceptable Use Policy

You agree NOT to use TidyCord for:

• Any illegal activity under applicable local, national, or international law
• Harassment, threats, or abuse of any individual or group
• Generating, distributing, or promoting hate speech or discriminatory content
• Spam or excessive automated requests
• Attempting to circumvent usage limits or authentication systems
• Injecting malicious code or attempting unauthorized access to any system
• Collecting personal data of Discord users without their consent
• Impersonating others or misrepresenting your identity or affiliation
• Violating Discord's Terms of Service or Community Guidelines
• Infringing third-party intellectual property rights
• Commercial exploitation of TidyCord's features without written permission

Violations may result in immediate, permanent termination of service without refund.

7. Intellectual Property

TidyCord, its source code, designs, and documentation are the intellectual property of Eduard Röhrig. You are granted a limited, non-exclusive, non-transferable license to use TidyCord for lawful purposes consistent with these Terms. You may not:

• Reverse engineer, decompile, or attempt to access TidyCord's source code
• Copy, modify, or create derivative works of the Service
• Resell, sublicense, or transfer your rights to use TidyCord

8. Disclaimer of Warranties

TidyCord is provided on an "AS-IS" and "AS-AVAILABLE" basis, without any warranties, express or implied. We specifically disclaim:

• Warranties of merchantability or fitness for a particular purpose
• Guarantees of uninterrupted, error-free operation
• Guarantees that AI features will produce accurate, complete, or appropriate content
• Guarantees of compatibility with all Discord server configurations
• Guarantees of data security against all possible breaches

9. Limitation of Liability

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of TidyCord, including but not limited to:

• Loss of data, profits, or revenue
• Server downtime or service interruptions
• Issues arising from AI-generated content
• Unauthorized access to your Discord data

Our total liability for any claim shall not exceed the amount you paid for Premium subscriptions in the preceding 12 months, or €100, whichever is greater. For free-tier users, liability is limited to €50.

10. Termination

By You: Remove TidyCord from your Discord server at any time. This immediately terminates your license to use the Service.

By Us: We may terminate your access immediately, without notice, if you:

• Violate these Terms or the Acceptable Use Policy
• Violate Discord's Terms of Service
• Engage in activity that may harm TidyCord, other users, or third parties

If we discontinue TidyCord generally, we will provide 30 days' notice where possible. Premium subscriptions will not be refunded upon termination for violation of these Terms.

11. Right of Withdrawal (German Law — Widerrufsrecht)

If you are a consumer in Germany, you have the right to withdraw from the Premium subscription contract within 14 calendar days from the date of purchase, without providing any reason.

Note: If Premium features have been used before the withdrawal deadline, you may be charged for actual use of the service. The right of withdrawal expires if the service has been fully performed and you explicitly acknowledged this before beginning.

Refunds will be processed using the same payment method Discord used for the original transaction, within 14 days of receiving your withdrawal notice.

12. Changes to These Terms

We may update these Terms at any time. Material changes will be communicated via our website or the bot's status. The "Effective Date" at the top of this page will be updated. Continued use of TidyCord after changes constitutes acceptance of the revised Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of Germany, specifically the laws of Lower Saxony (Niedersachsen), without regard to conflicts-of-law principles.

Any disputes shall be resolved exclusively by the courts located in Hannover, Germany, unless mandatory consumer protection laws in your jurisdiction require otherwise.

We encourage you to contact us first at info@eduardroehrig.de to resolve disputes amicably before initiating legal proceedings.

14. Severability and Entire Agreement

If any provision of these Terms is found invalid or unenforceable, it shall be modified to the minimum extent required, or severed. All remaining provisions remain in full force.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Eduard Röhrig regarding TidyCord.
